<title>Ігор Смешко: CORRUPTION: laws to combat. Theses for the Plan and Strategy to Rebuild Ukraine (Part 6.2) </title>

The nature of corruption and the laws governing the fight against it have long been known. American scholars, Professor Robert Klitgaard and Nobel laureate Gary Becker, have even derived scientific formulas for corruption. According to Professor Klitgaard, the equation is: C = M + D – A, where C stands for CORRUPTION, M for the MONOPOLY of power to make backroom decisions opaque to the public, D – DISCRETION in selective justice and impunity for officials and business tycoons close to power, and A – ACCOUNTABILITY and AUDITABILITY of those in power to society, the law and the justice system.

Professor Becker expresses this formula as a mathematical inequality:

 (1 – P) • E (U) > R • S • L, where P is the probability of punishment for corruption, ranging from 0 to 1;  (1 – P)  is the probability of evading punishment for corruption; E (U)  is the expected utility of corrupt activities; R is risk; S is the severity of punishment for corruption; and L is the lawful income from lawful activities.

According to these formulas, corruption becomes virtually unbeatable in countries governed by an authoritarian regime that is not accountable to society or to the laws of democracy, even when it calls itself a 'democracy', includes the word in its Constitution, formally holds elections and publicly performs ritualistic pseudo democratic procedures, in reality concealing and enabling the operations of privatised law enforcement agencies, security forces, courts and a distorted legal system that bears absolutely no resemblance to the laws of democracy (https://blogs.pravda.com.ua/authors/smeshko/68a5dd747bc1f/).

Has our country had any other path since 1991? Yes, it has. In the first year of Ukraine's independence, Zbigniew Brzezi&amp;#324;ski warned Ukraine against attempting to 'reinvent the wheel' when creating a new legal system that would comply with the principles of democracy. During a meeting in Washington with Ukraine's military attach&amp;#233; to the US, he advised adopting new laws immediately through a single package decision by parliament. This should have been precisely a comprehensive SYSTEM of laws from any Western country, one that had already been tested by the long-standing existence of a stable democracy.

'If you waste time searching for your 'own' democratic laws, you will end up with a host of oligarchs and a dysfunctional legal system. This will fuel state corruption. What matters is not the number of laws containing words about democracy, but effective justice and citizens' respect for the law as a national tradition. Benevolence should spur success, not invite ridicule due to an inability to 'adapt' to life with corruption."

I also recall a remark I received from the leadership of military intelligence at the time, following my suggestion to forward a transcript of this conversation with Dr Brzezi&amp;#324;ski to the President of Ukraine. I was told that this was purely a 'political matter' and did not pertain to the activities of a military attach&amp;#233; or military intelligence.



Only later, in a 2019 interview with The Day (Den) newspaper, did the first President, Leonid Kravchuk, confirm that no one in Ukraine's leadership knew how democracy ought to be built or understood the laws governing its existence (https://day.kyiv.ua/article/podrobytsi-litnya-shkola-zhurnalistyky/tsi-vybory-mozhut-buty-nashoyu-ostannoyu-pomylkoyu).

The process of building democracy in Ukraine remains unfinished precisely because the politicians who made strategic decisions lacked the necessary knowledge and genuine plans for its construction. Meanwhile, non-partisan professionals were not only deprived of the opportunity to make strategic decisions, but continue to this day to be silenced and prevented from being elected to political office in Ukraine.

Let us reiterate: the People of Ukraine, unlike those of Russia, are authentically European and, in their overwhelming majority, Christian. The global Ukrainian population stands at nearly 50 million. Christian cultural and moral traditions, just like European democratic traditions, are predominant in Ukraine. There are also Muslim Tatars living in Ukraine, but they number no more than half a million citizens. Geographically, Ukraine is situated in the heart of Europe, whilst to the north and east of its borders lie European Belarus and the European part of Eurasian Russia. Therefore, historically and naturally, Ukraine can have only one future – to be part of the pan-European civilisational and cultural space of the democratic European nations.

However, the development of modern forms of European democracy in Ukraine would be impossible without first formulating a Strategy – an architectural plan for such development – which is also necessary to raise the level of political culture within civil society. While society has learned to rise up against authoritarianism, it has yet to master electing a worthy government in its aftermath. It is precisely for this reason that we need to formulate and disseminate the principles for building modern forms of democracy and fundamental democratic values, which the new post-war elected representatives must adhere to and put into practice – not just in words, but in deeds.

The First Law of modern democracy can be defined as the law of the requisite development of the socio-economic foundation and the political culture of civil society aimed at ensuring the successful functioning of democratic institutions.

These must be sufficient to ensure the functioning of democratic institutions of government, public oversight of the authorities, and the necessary adaptation of the country's governance mechanisms to safeguard democracy in line with changes in both the domestic and international environments surrounding the country.

The Second Law of modern democracy, I believe, can be described as the law of the configuration (distribution, balance and checks) of the branches of government in a democracy.

It holds that genuine-rather than merely formal-electivity, accountability and transparency of the authorities in a democracy, as well as the equality of all citizens before the law, can only be ensured through the genuine separation of the three branches of government.

The Third Law of modern democracy can be described as the law of political stability, continuity and professionalism of public administration bodies in a democracy.

As a technocrat, I understand that democracy is an extremely complex socio-economic SYSTEM, far more complex than a technical one.

One such law is that any attempt to improve a single element of a holistic SYSTEM is guaranteed to impair the functioning of the SYSTEM as a whole.

Consider, then, the damage that has already been caused over the years of Ukraine's independence by the unsystematic reforms of its governing bodies... This was the cause of the two Maidan protests in Kyiv.

<title>Ігор Смешко: КОРУПЦІЯ: закони боротьби. Тези до Плану і Стратегії Відновлення України (частина 6.2) </title>

Природа корупції і закони боротьби з нею є давно відомими. Американські вчені, професори Роберт Клітгаард і лауреат Нобелівської премії Гері Беккер вивели навіть наукові формули корупції. Згідно з професором Клітгаардом, це рівняння: К = М + Д – П, де К – КОРУПЦІЯ, М – МОНОПОЛІЯ влади на кулуарні і непрозорі для суспільства рішення, Д – ДИСКРЕЦІЯ у вибірковому правосудді та безкарності наближених до влади чиновників і ділків від бізнесу, П – ПІДЗВІТНІСТЬ і ПІДКОНТРОЛЬНІСТЬ влади суспільству, закону і правосуддю.

У професора Беккера ця формула має вигляд математичної нерівності:

 (1 – ВПК) • КП > Р • ЖП • ЧП, де ВПК – вірогідність покарання за корупцію, значення якої становить від 0 до 1; (1 – ВПК) – вірогідність уникнення покарання за корупцію; КП – можливий прибуток внаслідок корупційної діяльності; Р – ризик; ЖП – жорстокість покарання за корупцію; ЧП – можливий прибуток внаслідок законної діяльності.

Згідно з цими формулами, корупція стає практично непереможною в країнах, де існує непідконтрольна суспільству і законам демократії авторитарна влада. Навіть коли вона називає себе "демократією", має це слово в Конституції, формально проводить вибори і публічно виконує ритуальні псевдо-демократичні процедури. За якими насправді ховаються і діють приватизовані правоохоронні органи, силові структури, суди і спотворена правова система, яка абсолютно не відповідає законам демократії (https://blogs.pravda.com.ua/authors/smeshko/68a5dd747bc1f/).

Чи був у нашої країни інший шлях ще з 1991 року? Був. У перший рік незалежності України Збігнєв Бжезінський застеріг Україну від спроби винаходу "велосипеда" при створенні нової правової системи, яка відповідала б законам демократії. Під час зустрічі у Вашингтоні із військовим аташе України в США він порадив прийняти нові закони відразу одним пакетним рішенням парламенту. Це мала б бути саме цілісна СИСТЕМА законів будь-якої з країн Заходу, яка вже була випробувана тривалим існуванням сталої демократії.

"Якщо втратите час на пошук "власних" демократичних законів, отримаєте купу олігархів і непрацюючу правову систему. Це буде живити державну корупцію. Головне не кількість законів зі словами про демократію, а діюче правосуддя і законослухняність громадян як національна традиція. Доброчинність має стимулювати успіх, а не викликати насмішки через нездатність "пристосуватися" до життя із корупцією".

Пам'ятаю і зауваження, яке отримав від керівництва воєнної розвідки того часу, за пропозицію направити запис цієї бесіди з доктором Бжезінським Президентові України. Отримав дорікання, що це суто "політичне питання" і воно не стосується діяльності воєнного аташе і воєнної розвідки.



Тільки пізніше, в інтерв'ю газеті "День" у 2019 р., перший Президент Л. Кравчук підтвердив, що ніхто в керівництві України не знав, як саме потрібно будувати демократію, і не знав законів її існування (https://day.kyiv.ua/article/podrobytsi-litnya-shkola-zhurnalistyky/tsi-vybory-mozhut-buty-nashoyu-ostannoyu-pomylkoyu) .

Будівництво демократії в Україні тому і не завершене, що політики, які приймали стратегічні рішення, не мали відповідних знань і щирих планів її будівництва. А позапартійні професіонали були позбавлені не тільки можливості прийняття стратегічних рішень, але й продовжують піддаватися до цього часу замовчуванню та блокаді можливості бути обраними до політичної влади в Україні.

Нагадаємо ще раз: Народ України, на відміну від Росії, є аутентичним європейським і в абсолютній більшості – християнським. Якщо брати загальну кількість українців у світі, то це майже 50 мільйонів. Християнські культурні і моральні традиції, як і європейські демократичні традиції, є домінантою в Україні. В Україні проживають і мусульмани-татари, але їх не більше пів мільйона громадян. Географічно Україна розташована у центрі Європи, а на півночі та на сході її кордонів – європейська Білорусь і європейська частина євразійської Росії. Тому історично-природним майбутнє України може бути лише одне – перебування у загальноєвропейському цивілізаційному і культурному просторі демократичних країн Європи.

Але будівництво в Україні сучасних форм європейської демократії було б неможливим без попередньої розробки Стратегії – архітектурного плану такого будівництва. Яка потрібна і для підняття рівня політичної культури громадянського суспільства. Повставати проти авторитаризму воно вже вміє, але обирати після цього гідний уряд ще ні. Саме для цього і потрібне формулювання та поширення законів будівництва сучасних форм демократії і базових демократичних цінностей, яких не на словах, а на ділі мають додержуватись і впроваджувати в життя нові повоєнні обранці.

Такі три основні закони демократії були сформульовані мною і опубліковані перед останніми президентськими виборами у 2019 році (https://day.kyiv.ua/article/den-planety/nevyvcheni-uroky-hetmanatu-ta-natsionalna-ideya-ukrayiny-u-suchasnykh-umovakh2). Вони отримали Свідоцтво про реєстрацію авторського права N87693 від 11 квітня 2019 року.



Першим законом сучасної демократії можна назвати закон необхідного рівня розвитку соціально-економічної бази і політичної культури громадянського суспільства з метою забезпечення успішного функціонування інститутів влади за демократії. Цей закон полягає в тому, що необхідними, але не достатніми умовами для існування в країні успішної демократії є наявність критичної маси заможного СЕРЕДНЬОГО КЛАСУ і певного рівня політичної культури громадянського суспільства.

Вони мають бути достатніми для забезпечення функціонування демократичних інститутів влади, контролю над владою з боку суспільства і необхідної адаптації алгоритмів управління в країні для захисту демократії відповідно до змін як внутрішнього, так і зовнішнього середовища навколо країни.

Другим законом сучасної демократії, вважаю, можна назвати закон конфігурації (розподілу, балансу і противаг) органів влади за демократії.

Він полягає в тому, що справжня, а не формальна виборність, підзвітність і прозорість органів влади за демократії, а також рівність усіх громадян перед законом можуть бути забезпечені лише за реального відокремлення одна від одної трьох гілок влади: законодавчої, виконавчої і судової. При тому, що максимально можлива кількість внутрішніх функцій державного управління має бути передана на якомога нижчий із можливих рівень управління – у місцеве самоврядування, а права парламентської опозиції – визначені і захищені законом.

Третім законом сучасної демократії можна назвати закон політичної стабільності, сталості і фаховості органів державного управління за демократії. Він полягає в тому, що необхідною, але не достатньою умовою для політичної стабільності за демократії є наявність у країні принаймні двох заснованих на ідеології демократії партій не вождистського типу. Ці партії можуть відрізнятися одна від одної різним баченням процесів еволюційного розвитку Світу. Одна може бути консервативною, інша – ліберальною, але їх мають об'єднувати спільні демократичні цінності: виборність, підзвітність і відкритість органів державної влади перед суспільством.

Обидві такі ідеологічні партії мають бути свідомо антиреволюційними і мати підготовлений фаховий кадровий резерв для управління державою за умов демократії. Бути готовими не лише управляти країною, але й підкорятися волі виборців і періодично перебувати у парламентській опозиції. Цінувати принцип верховенства права більше, ніж власну ідеологію, і здійснювати ефективний контроль над виконавчою гілкою влади протягом усього часу перебування в опозиції.

Що стосується збереження сталості і фаховості органів управління за демократії, то це має забезпечуватися законодавчо визначеною системою захисту позапартійних кадрових професіоналів від протиправного впливу на них з боку політиків. Політики змінюються при владі після кожних виборів, а позапартійні професіонали кар'єрно зростають протягом десятиліть роботи. Вони і мають бути носіями інституційної пам'яті, фаховості і сталих державницьких традицій органів управління. Запорукою усього цього мають бути свобода слова і вільні від протиправного впливу фахові і патріотичні засоби масової інформації – четвертий елемент недержавної влади за демократії.

Мені як технократу зрозуміло, що демократія – це надскладна соціально-економічна СИСТЕМА, набагато складніша за технічну. У неї, як і у технічних систем, є свої об'єктивні закони розвитку.

Однією з таких закономірностей є те, що будь-яка спроба покращити один елемент цілісної СИСТЕМИ гарантовано погіршує роботу СИСТЕМИ у цілому. Покращити елемент СИСТЕМИ можна лише після попереднього аналізу його місця в ієрархії цілісної СИСТЕМИ. Цьому має передувати аналіз зв'язків даного елемента з іншими, впливу елемента на призначення і цільову функцію СИСТЕМИ у цілому та впливу на них зовнішнього середовища.

Тому уявіть, яку шкоду за роки незалежності України вже принесли безсистемні реформи її органів управління. Внаслідок приходу до влади людей, які не володіли навіть азами системного аналізу і синтезу більш простих технічних СИСТЕМ. Але сміливо втручалися у процеси начебто демократичного державотворення, насправді руйнуючи його паростки в органах влади. Прикривалися псевдодемократичною риторикою, але намагалися скопіювати олігархічно-кланову авторитарну модель управління на кшталт російської. Це і стало причиною двох протестних Майданів у Києві.

The more corrupt the state, the more numerous the laws 

 (Publius Cornelius Tacitus, Roman historian, 1st-2nd century AD) 

Ukraine's experience confirms the wisdom of these classical maxims. Laws and subordinate legislation that paved the way for corruption in Ukraine began to proliferate following the country's declaration of independence and the proclamation that it had become a "democratic state." As history demonstrates, a declaration of intent has never, by itself, automatically brought about the promised outcome. Building such a complex system of public governance as democracy requires a thorough understanding of the principles upon which it is founded (https://blogs.pravda.com.ua/authors/smeshko/68a5dd747bc1f/).

Moreover, what needed to be built was not merely a new "vertical of power", as was sometimes advocated by the "new-old" political establishment, but rather an entirely new "pyramid of power." These two concepts differ as much as a low-grade domestic Zaporozhets clunker differs from a luxury German Mercedes. None of the political pseudo-elites elected to power throughout the years of Ukraine's independence succeeded in accomplishing this task. Without a sound understanding of the principles of democratic governance, it was impossible to prepare for combating corruption, which is an inherent challenge even within democratic systems.

Government corruption and the shadow economy also existed in the USSR. But their scale was incomparable to the opportunities that opened up for shrewd dealers during the privatisation of state property and the uncontrolled liberalisation of the market. The example of the almost destitute fate of the families of the General Secretaries of the USSR after their dismissal from office, and the mass executions of corrupt officials in China today, are good illustrations of the difference in the scale of corruption under free market conditions.

The first two presidents of Ukraine acknowledged their ignorance of democratic law. President Leonid Kravchuk stated this in 2019: 'In 1991, we proclaimed that Ukraine had become a democratic state... We suddenly began to build a new state. We had no knowledge of the new SYSTEM, even though we were educated, people... But this knowledge was completely at odds with what we needed in the new Ukraine. The second president, Leonid Kuchma, even upon his appointment as Prime Minister in October 1992, addressed the members of the Parliament of Ukraine with a request: 'Just tell me what to build, and I will build it.'

Such ignorance meant that the privatisation carried out did not, as in neighbouring Poland, lead to the emergence of mass numbers of small and medium-sized business owners – the foundation of the MIDDLE CLASS, which serves as the social basis for building DEMOCRACY. On the contrary, its predatory nature towards the people of Ukraine led to a dramatic stratification of society and the emergence of the super-rich and, subsequently, full-fledged oligarchs. The latter soon gained control over parliamentary parties and the government, not only through 'puppet' MPs and ministers, but also through corrupt officials and law enforcement officers.

The 'shadow market' of the past and membership of the party and Komsomol nomenclature provided a good training ground for becoming extremely wealthy. Having acquired vast financial resources, some of them 'gained access to power'. This enabled them to 'buy' new power for themselves. The shrewdest became oligarchs. To quote Aristotle: 'Those who buy power with money become accustomed to profiting from it'. The process of 'investing in politics' becomes continuous and ever-present, whilst all the 'new political faces in power' become mere puppets in the deft hands behind the scenes of the puppet theatre of pseudo-democracy.

We must therefore soberly acknowledge that, throughout all the years of independence, no one in Ukraine has yet even begun the scientifically grounded construction of DEMOCRACY as a complex socio-economic SYSTEM. All the 'democratically branded' political parties and politicians who criticised the 'previous regime' for authoritarianism did so only in words. Once in power, they merely refined the authoritarianism that actually existed. They were content with authoritarian rule and the resource-based economic model, which form the basis for their own self-enrichment. And what they called democracy in words actually has another name: oligarchic-clan-based and regionally neo-feudal authoritarianism.

As for another marker of corruption, according to Tacitus: 'the more corrupt the state, the more numerous the laws', one of the first acts to pave the way for this can be considered Decree No. 1805-XII of the Speaker of the Parliament of Ukraine dated 11 November 1991 'with a view to the practical implementation of the ideas of George Soros'  (https://zakon.rada.gov.ua/laws/show/1805-12#Text). This did not involve transferring knowledge on building democracy to Ukraine, which would have been desirable and understandable, for example, experience in developing branches of government independent of one another, genuine ideological parties committed to the principles of democracy rather than clan-based or leader-centred parties, and the creation of a legal framework, system, mechanism and procedures for overseeing government activities (https://blogs.pravda.com.ua/authors/smeshko/68a5dd747bc1f/).

No, Mr Soros's 'idea' lay elsewhere. The well-known transnational financier and 'globalist', who is said to have made a profit of 1 billion dollars from the collapse of the British pound sterling in a single day, on 16 September 1992, proposed introducing clearing settlements for goods and services in Ukraine. Naturally, this was to be carried out with his advisory assistance and mediation. The only problem was that Ukraine did not yet have any state system for assessing their value at world prices, analysing potential sales markets, assessing the reputation of counterparties, or a mechanism for monitoring settlements. Embassies abroad were only just being opened, intelligence agencies had not yet been established, and Ukraine's first Law 'On Intelligence' was only adopted in 2001, despite opposition from the then government and the leadership of the Security Service of Ukraine (SSU)...



However, the complete dismantling of Ukraine's entire legal framework and the opening of legal loopholes for corruption-which was already rampant-as well as the emergence of a multitude of laws and subordinate legislation that continue to fuel it to this day began in 2005. This is linked to the actions of Ukraine's third president, Viktor Yushchenko.

The first two presidents, at least, possessed a good education, broad-mindedness and experience of systematic public administration. They made fatal mistakes in their choice of personnel. They failed to establish new ideological parties that would be committed to the principles of democracy, which deprived them of the necessary pool of talent. The so-called 'personal loyalty' of their subordinates turned out to be a betrayal of both themselves and Ukraine. Yet they still understood the importance of professionalism and expertise. Their activities were scrutinised by a parliamentary opposition that was genuinely active in the Parliament. Public opinion in the country mattered, and the media were not yet under the complete control of either the authorities or the oligarchs. Some of them were openly opposed to the government.

The fragile balance of power among the branches of government and the existing political forces in Ukraine, as well as the resilience of the governing bodies-thanks to their still fairly competent professional capacity, painstakingly built over the previous years of independence-was destroyed by Ukraine's third president.

A Soviet-trained financier by education, lacking a systematic and broad-ranging view of the world, Viktor Yushchenko not only lacked knowledge of the principles of democracy, but also made no effort to seek out those who might have helped him in this regard. The transition from an authoritarian system of governance to a democratic one was not his objective. Lacking experience of independent governance in his previous posts, which had been characterised by his predecessor's authoritarian leadership style, he appears merely to have replaced a paternalistic model of serving the "father figure" with elements of narcissism, messianism, and self-admiration. Instead of showing gratitude to the people who had brought him to power in 2004, he believed he had already fulfilled his mission by 'bestowing freedom' and giving the world a 'new model of democracy'.

According to a long-standing friend and head of his administration, O. Rybachuk: '...When Viktor Yushchenko was running for the presidency, he did not set himself the task of changing the system at all... He had a well-known saying that on the day after the Kuchma regime collapsed, tens of thousands of Ukrainians would somehow come to power by themselves; all you had to do was remove that regime, and everything else would begin to grow on its own. He did not consider it his duty to put together this team; he did not formulate his own political agenda; he had no reform plan of his own; at one point, he even asked us to map out a year-long schedule of what he was supposed to do..." Without changing the system of power, Yushchenko used the term 'revolution' as a pretext for the unconstitutional dismissal of tens of thousands of the most experienced professionals. In doing so, he effectively cleared positions for his 'dear friends' (liubi druzi) and their prot&amp;#233;g&amp;#233;s, most of whom had already been part of the 'criminal regime' they criticised, whilst concealing the fact that, until very recently, they themselves had been part of it. This applied not only to his 'dear friends' who had been removed from office on grounds of discrediting behaviour or corruption, but also to Yushchenko himself. In 1994, the Prosecutor General's Office of Ukraine brought criminal charges against him personally for the theft of 25 million US dollars from Bank Ukraine in 1991 (https://www.pravda.com.ua/news/2016/06/13/7111575/).





As it soon transpired, public criticism of the previous 'criminal regime' was necessary in order to return to it, and indeed to its highest echelons, not with the aim of dismantling the old 'criminal' SYSTEM, but to exploit it for even greater personal enrichment. It was these 'dear friends' and their 'political prot&amp;#233;g&amp;#233;s' who initiated the massive destruction of professionalism within the governing bodies, of the legal framework designed to prevent corruption, and of the creation of new laws and subordinate legislation which only accelerated corruption and created the conditions for absolute impunity.

The legal system that had developed in Ukraine before the Orange Revolution was not perfect. But it was coherent and, together with the presence within Ukraine's law enforcement agencies of a critical mass of career professionals, more or less ensured the protection of Ukraine's national interests. Evidence of this included: the successful repulsion of the first attempt at Russian aggression near Tuzla Island in 2003; the prevention of bloodshed during the Maidan protests in 2004; and the thwarting of Yanukovych's first attempt to seize power in Ukraine through electoral manipulation.

Non-partisan professionals do not require instructions from the political leadership to fulfil their constitutional duty. For example, the security forces' initial response to the provocation near Tuzla Island and the SSU's first arrest of Police General Pukach in the Gongadze case in 2003 took place without consultation with the President. He was on official visits outside Ukraine at the time. He first learnt of the decisions and actions taken by the leadership of the security forces from the media. The decisions and actions taken by the SSU leadership in 2004 to halt the deployment of armed Internal Troops units into Kyiv to disperse the Maidan protests were also made without any prior political consultation.

Article 35 of the Law of Ukraine 'On the Security Service of Ukraine' still provides for independent decision-making within the scope of its officers' powers, as well as their duty to refuse unlawful orders. Unlawful actions and inaction result in liability: either disciplinary or criminal. Permanent staff of the SSU cannot be political appointees and have the status of military personnel. They were subject to the body of laws on military service. The politicisation of law enforcement and security agencies was initiated by Yushchenko. Under his leadership, loyal politicians began to be appointed to their leadership positions instead of permanent, non-partisan professionals.

Subsequently, ultra-wealthy political sponsors joined in, thereby finally transforming themselves into oligarchs, and their numbers began to grow. Let us not forget that before 2005, Pavlo Lazarenko could be considered the first and sole fully fledged oligarch. He was the only one among the ultra-wealthy who had a parliamentary party and his own media outlets, corrupt links within the leadership of law enforcement agencies and with international organised crime, and had a genuine chance of becoming the next President of Ukraine.

US national security archives, now declassified, show that the key success in the fight against corruption in Ukraine was achieved not by politicians, but through expert cooperation between non-partisan professionals from the Prosecutor General's Office, Ukrainian military intelligence and the US FBI. This is evidenced by the only successful special hearings for Ukraine held in the US Congress in April 1998 on combating international organised crime and corruption (https://www.govinfo.gov/content/pkg/CHRG-105shrg46099/pdf/CHRG-105shrg46099.pdf). It is also evidenced by the tragic fate of Yevhen Kostiuchenko, a captain in Ukraine's military intelligence, who was involved both in the investigation into Lazarenko's crimes and in those congressional hearings. Following the victory in 2000 of the SSU leadership, headed by L. Derkach, in their struggle against the leadership of the Main Intelligence Directorate of the Ministry of Defence, the latter was dismissed, and the unit in which Captain Kostiuchenko served was disbanded. He was forced to emigrate to the USA. He soon went on to have an outstanding career in the police there and was killed whilst on duty. A road in Ventura County, California, was named in his honour, and he was posthumously awarded the highest police honour in the United States... (https://ukrainainc.net/2023/03/06/11585/).

As we can see, even before 2005, there were serious problems in the work of special services and law enforcement agencies. The dissolution in 1998 of the Committee on Intelligence, which was, in essence, a betrayal of the military intelligence leadership in 2000, followed by political reprisals against it and the absolute trust placed in the head of the SSU, L. Derkach, resulted in the Сassette (also known as Tapegate) and Kolchuga Scandals and the tragedy surrounding the murder of Georgiy Gongadze. But by 2003, professionalism within Ukraine's security forces had been restored. This made possible the peaceful and bloodless Maidan of 2004.

The roots of yet another tragedy – the now bloody Maidan uprising of 2014 – were laid precisely in 2005. An imperfect but coherent system of professional appointments within Ukraine's security agencies was dismantled precisely after the Orange Revolution, initially under pseudo-'revolutionary' slogans during Yushchenko's presidency, and later – under pseudo-'democratic' slogans of endless 'reforms' and 'improvements' to organisational and staffing structures by his followers. Appointments to the leadership of the security and law enforcement agencies began to be made solely on political grounds, rather than based on career professionals. Under the 're-certification procedure', even general's ranks began to be bestowed upon such individuals. The fight against corruption not only failed to intensify but was practically scaled back. Corruption gained momentum, becoming more cynical and overt. It is now virtually unchecked...

In 2015, John Herbst, the US ambassador during the Orange Revolution, admitted that the hopes raised by the 2004 Maidan in the fight against corruption had not only failed to materialise but that corruption had actually worsened significantly.

"Ukraine has a very serious problem with corruption because, frankly, the very top of your elites are corrupt. The very top. I will not name them now, but even people at the very top, who know how to talk to Westerners in reform language and say all the right things, prospered under the old SYSTEM."

"They are able to jump from one party to another, in some cases, to manoeuvre between several parties – and, somehow, to remain untouched and to prosper. They learned to prosper under the old rules, and those rules are very convenient for them. And if they are convenient for you when you are a minister (in the previous government, which they criticised as soon as they lost their posts), imagine how convenient they will be for you when you are above that level. So these folks are a problem, but this is the leadership that you have...

... Civil society in Ukraine at independence was somewhat robust. That's why it is not surprising that you had a real democratic referendum on Independence in Ukraine, that you had a democratic transfer of power at the very first presidential election, or the second, when Kravchuk gave way to Kuchma, – and that was before the Orange Revolution! And the Orange Revolution would not have been possible without a mobilised civil society, albeit mobilised by corrupt leadership."

"...I had problems in my Embassy (I worked here from 2003 to 2006) because my Embassy were enthusiasts for the Orange team. And I remember telling them two things that were very important. One, the United States did not have a favourite candidate in that election. We were in favour of a fair election. And the second very important thing I said to them after Yushchenko went on the boards was: "Take a look at Yushchenko's team. How different they really are from the Kuchma's team or the Yanukovych's team?".

So I was one of the few people at the Embassy, or if that matters, in official Washington, who was not surprised when Yushchenko and Timoshenko fell out and when the Yushchenko government made the corrupt bargain on gas in January 2006, when the international community was looking forward to a win for Ukraine, and the destruction of all non-transparent gas relationships. But someone at the very top of Ukraine at that moment got very rich, rather than doing the right thing. <title>Ігор Смешко: КОРУПЦІЯ: причини та генезис. Тези до Плану і Стратегії Відновлення України (частина 6.1) </title>

Досвід України підтверджує класичну античну мудрість. Закони і підзаконні акти, які відкрили шлях до корупції в Україні, почали з'являтися у великій кількості після проголошення незалежності України і декларування, що вона стала "демократичною країною". Декларація про наміри, як відомо, ще ніколи сама по собі автоматично не створювала обіцяного. Для будівництва такої складної системи державного управління, якою є демократія, були потрібні знання законів її побудови (https://blogs.pravda.com.ua/authors/smeshko/68a5dd747bc1f/).

Причому будувати було потрібно навіть не нову "вертикаль влади", про яку іноді велася мова "новими – старими" політиками, а нову "піраміду влади". Ці два різні наукові визначення різняться одне від одного, як вітчизняний автомобіль "Запорожець" від німецького "Мерседеса". Жодна з політичних псевдоеліт, які обиралися до влади за всі роки незалежності, не впоралася із цим завданням. Без знань законів демократії підготуватися до боротьби з корупцією, яка є притаманною і цій системі державного управління, було неможливо.

Владна корупція і тіньовий ринок існували і в СРСР. Але їхні розміри були незрівнянними з можливостями, які відкривалися для спритних ділків під час приватизації державної власності і безконтрольної лібералізації ринку. Приклад майже жебрацької долі сімей генеральних секретарів СРСР після їх звільнення з посад і масових сучасних страт корупціонерів у Китаї – гарні ілюстрації різниці у масштабах корупції в умовах вільного ринку.

Перші два президенти України визнавали своє незнання законів демократії. Президент Леонід Кравчук засвідчив це у 2019 році: "У 1991 році ми проголосили, що Україна стала демократичною державою... Ми раптом почали будувати нову державу. Знань нової СИСТЕМИ не було, хоча ми були освіченими людьми... Але ці знання були зовсім протилежними до того, що нам потрібно було в новій Україні. Другий президент Леонід Кучма ще при затвердженні його на посаду Прем'єр-міністра у жовтні 1992 р. звернувся до депутатів Верховної Ради із проханням: "Ви скажіть мені, що потрібно будувати? А я – збудую".

Похідним такого незнання стало те, що проведена приватизація не призвела, як у сусідній Польщі, до появи масового малого і середнього власника – основи СЕРЕДНЬОГО КЛАСУ. Який є соціальною базою для будівництва ДЕМОКРАТІЇ. Навпаки, її грабіжницький характер по відношенню до Народу України призвів до драматичного розшарування суспільства і до появи надбагатіїв, а згодом – повноцінних олігархів. Останні невдовзі отримали можливість контролю над парламентськими партіями і урядом не тільки через "кишенькових" депутатів і міністрів, але й через корумпованих чиновників і правоохоронців.

Минулий "тіньовий ринок" і належність до партійно-комсомольської номенклатури були гарною тренувальною базою для того, щоби стати надбагатим. Отримавши ж гігантські фінансові ресурси, деякі з них "наблизились до влади". Що дало їм можливість вже самим "купувати" нову владу. Найбільш спритні стали олігархами. Далі – за Аристотелем: "ті, хто купують владу за гроші, звикають одержувати з неї прибуток". Процес "інвестицій у політику" стає безперервним і постійно діючим. А усе "нові політичні обличчя при владі" стають лише маріонетками у спритних руках за кулісами лялькового театру псевдодемократії.

Отже, треба тверезо визнати, що за усі роки незалежності до науково обґрунтованого будівництва ДЕМОКРАТІЇ як складної соціально-економічної СИСТЕМИ в Україні ще й ніхто не приступав. А усі "демократично забарвлені" політичні партії і політики, які критикували "попередню владу" за авторитаризм, робили це лише на словах. Діставшись влади, вони лише удосконалювали реально існуючий авторитаризм. Їх влаштовувала авторитарна влада і модель сировинної економіки, які є основою для власного самозбагачення. А те, що вони на словах називали демократією, насправді має іншу назву: олігархічно-клановий і регіонально-неофеодальний авторитаризм.

Що ж до іншого маркера корупції, згідно з Тацитом: "чим більше в державі корупції, тим більше законів", то прикладом одного із перших актів, які відкрили шлях до неї, можна вважати Розпорядження Голови Верховної Ради України N1805-XII від 11 листопада 1991 року "з метою практичної реалізації ідеї Дж. Сороса" (https://zakon.rada.gov.ua/laws/show/1805-12#Text). Яка полягала не у передачі Україні знань будівництва демократії, що було б бажаним і зрозумілим. Наприклад, досвіду розбудови незалежних одна від одної гілок влади, справжніх ідеологічних, відданих законам демократії, а не кланово-вождистського типу партій, і створення правової бази, системи, механізму і процедур контролю за діяльністю урядів (https://blogs.pravda.com.ua/authors/smeshko/68a5dd747bc1f/).

Ні, "ідея" пана Сороса полягала у іншому. Відомий транснаціональний фінансист і "глобаліст", якому приписують отримання прибутку у 1 мільярд доларів за обвал в один день, 16 вересня 1992 р., британського фунта стерлінгів, запропонував ввести в Україні клірингові розрахунки за товари і послуги. Зрозуміло, при його консультативній допомозі і посередництві. Проблемою було лише те, що в Україні ще не існувало будь-якої державної системи оцінки їх вартості за світовими цінами, аналізу ринків можливого збуту, репутації контрагентів і механізму контролю за розрахунками. Посольства за кордоном тільки відкривалися, розвідувальні органи не були сформовані, а перший Закон України "Про розвідку" був прийнятий, при спротиві діючої влади і керівництва СБУ, лише у 2001 році...



Але повна руйнація усього правового поля України і відкриття правових шлюзів для вже галопуючої корупції та появи безлічі законів і підзаконних актів, які живлять її й донині, відбулося починаючи з 2005 року. І це пов'язано із діяльністю третього президента України Віктора Ющенка.

Перші два президенти принаймні мали гарну освіту, панорамне мислення і досвід системного державного управління. Вони робили фатальні кадрові помилки. Не створили нових ідеологічних партій, які були б віддані законам демократії. Що не дало їм самим потрібного кадрового резерву. Декларована "особиста відданість" підлеглих оберталася зрадою і їх самих, і України. Але вони ще розуміли значення професіоналізму і фаховості. Їх діяльність була під наглядом парламентської опозиції, яка реально діяла у Верховній Раді. Суспільна думка в країні мала значення, а медіа ще не були під повним контролем не тільки влади, але й олігархів. Частина з них була відкрито опозиційною до влади.

Крихкий баланс сил між гілками влади і наявними політичними силами в Україні, а також запас стійкості органів управління за рахунок ще доволі фахової професійної їх складової, яка з такими великими потугами народжувалася за попередні роки незалежності, зруйнував третій президент України.

Радянський фінансист за освітою, без системного і панорамного бачення Світу, Віктор Ющенко не тільки не володів знаннями законів демократії, але й не шукав тих, хто міг би допомогти йому у цьому. Зміна авторитарної системи управління на демократичну не була його метою. Не маючи досвіду самостійного управління на попередніх посадах за авторитарного стилю керівництва його попередника, він, здається, змінив лише стиль служіння "батькові" на елементи нарцисизму, месіанства і самозакоханості. Замість вдячності Народові, який привів його до влади у 2004 році, він вважав, що вже виконав свою місію, "подарувавши свободу" і давши Світові "новий зразок демократії".

За свідченням давнього друга і керівника його Адміністрації О.Рибачука: "...Віктор Ющенко, коли ішов до президенства, він взагалі не ставив собі за задачу зміну системи... В нього є відома фраза, що на другий день після того, як впаде режим Кучми, десятки тисяч українців самі якось прийдуть до влади і просто от забери цей режим, і воно почне рости звідкись. Він не вважав своїм обов'язком формувати цю команду, він не формував свою політичну аженду, він не мав свого плану реформ, він навіть в якийсь момент просив, щоб ми на рік розписали, що він має робити..." Не змінюючи СИСТЕМУ влади, Ющенко використав термін "революція" для антиконституційного звільнення з неї десятків тисяч найбільш досвідчених професіоналів. Чим "розчистив" місця для "любих друзів" та їх висуванців. Більшість з яких уже була при "злочинній владі", яку вони критикували, замовчуючи при тому, що ще донедавна самі були її частиною. Це мало відношення не тільки до "любих друзів", які були відлучені від влади за дискредитуючими або корупційними ознаками, але й до самого Ющенка. У 1994 р. Генеральна прокуратура України притягувала його самого до кримінальної відповідальності за фактом викрадення з банку "Україна" у 1991 році 25 мільйонів доларів США (https://www.pravda.com.ua/news/2016/06/13/7111575/).

Як виявилося невдовзі, публічна критика попередньої "злочинної влади" була потрібна, щоби повернутися до неї, ще на її вищі щаблі. З метою не руйнації старої "злочинної" СИСТЕМИ, а для її використання задля ще більшого особистого самозбагачення. З "любих друзів" та їх "політичних висуванців" і почалося вже гігантське руйнування професіоналізму органів управління, правового поля для запобігання корупції, а також створення нових законів і підзаконних актів, які лише прискорили корупцію і створили умови для вже повної безкарності.

Система права, яка склалася в Україні до Помаранчевої революції, не була ідеальною. Але вона була цілісною і разом із наявністю в силових органах України критичної маси кар'єрних, кадрових професіоналів більш-менш забезпечувала захист національних інтересів України. Свідченням чого були: успішна зупинка першої спроби російської агресії біля острова Тузла у 2003 році, запобігання кровопролиттю на Майдані 2004 року і блокування першої спроби Януковича захопити владу в Україні шляхом маніпуляцій на виборах.

Кадровим позапартійним професіоналам не потрібна вказівка політичного керівництва для виконання конституційного обов'язку. Для прикладу, перша реакція силових структур на провокацію біля острова Тузла і перше затримання СБУ генерала міліції Пукача у справі Гонгадзе у 2003 році відбулися без узгодження із Президентом. Він перебував з візитами за межами України. Про рішення і дії керівництва силових структур він отримав першу інформацію із ЗМІ. Рішення і дії керівництва СБУ у 2004 році щодо зупинки введення в Київ озброєних підрозділів внутрішніх військ для розгону Майдану також відбувалися без будь-яких попередніх політичних консультацій.

Стаття 35 Закону України "Про Службу безпеки України" й досі передбачає самостійне прийняття рішень у межах повноважень її співробітників, а також їх обов'язок відмови від незаконних наказів. Незаконні дії і бездіяльність мають наслідком відповідальність: або дисциплінарну, або кримінальну. Кадрові співробітники СБУ не можуть бути політичними призначенцями і мають статус військовослужбовців. На них поширювався комплекс законів про військову службу. Політизацію правоохоронних і силових органів започаткував Ющенко. При ньому замість кадрових і позапартійних професіоналів до їх керівництва почали призначати лояльних політиків.

Згодом до цього долучились і надбагаті політичні спонсори, чим остаточно перетворилися на олігархів, а їх число почало збільшуватися. Не забуваємо, що до 2005 року єдиним і першим повноцінним олігархом можна вважати лише Павла Лазаренка. Лише він серед надбагатих мав парламентську партію і власні ЗМІ, корумповані зв'язки у керівництві правоохоронних органів, з міжнародною організованою злочинністю і мав реальні шанси стати черговим Президентом України.

Розсекречені наразі архіви у сфері національної безпеки США свідчать, що ключовий успіх у боротьбі з корупцією в Україні забезпечили не політики, а фахова взаємодія позапартійних професіоналів Генеральної прокуратури, воєнної розвідки України і ФБР США. Про це свідчать єдині успішні для України спеціальні слухання в Конгресі США у квітні 1998 р. з питань боротьби із міжнародною організованою злочинністю і корупцією (https://www.govinfo.gov/content/pkg/CHRG-105shrg46099/pdf/CHRG-105shrg46099.pdf). А також трагічна доля капітана воєнної розвідки України Євгена Костюченка, який брав участь як у розслідуванні злочинів Лазаренка, так і у тих слуханнях у Конгресі. Після перемоги у 2000 році керівництва СБУ на чолі із Л.Деркачем у боротьбі із керівництвом ГУР МО останнього було звільнено, а підрозділ, у якому служив капітан Костюченко, розформовано. Він був змушений емігрувати до США. Невдовзі зробив там видатну кар'єру в поліції і загинув під час виконання службових обов'язків. На його честь названо проїзд у графстві Вентура, Каліфорнія, а він сам посмертно був нагороджений найвищою поліцейською нагородою США... (https://ukrainainc.net/2023/03/06/11585/).

Як бачимо, і до 2005 року існували серйозні проблеми у діяльності спеціальних служб і правоохоронних органів. Ліквідація у 1998 р. Комітету з питань розвідки, зрада, по суті, керівництва воєнної розвідки у 2000 р. із послідуючими політичними репресіями щодо нього і абсолютна довіра керівнику СБУ Л.Деркачу мали наслідком касетний і кольчужний скандали та трагедію із вбивством Георгія Гонгадзе. Але уже у 2003 році професіоналізм у силових структурах України був відновлений. Завдяки чому відбувся мирний і безкровний Майдан 2004 року.

Коріння ж чергової трагедії із вже кривавим Майданом 2014 року були закладені саме у 2005 році. Неідеальна, але цілісна система професійних кадрових призначень у силових органах України була демонтована саме після Помаранчевої революції. Спочатку під псевдо-"революційними" гаслами часів президентства Ющенка, згодом – під псевдо-"демократичними" гаслами безкінечних "реформувань" і "удосконалень" організаційно-штатних структур з боку його послідовників. У керівництво силових і правоохоронних органів почали призначати виключно з політичних мотивів, а не кар'єрних професіоналів. Яким у "порядку переатестації" стали присвоювати навіть генеральські звання. Боротьба з корупцією не тільки не посилилася, але й була практично згорнута. Корупція набрала обертів, стала більш цинічною і відкритою. Наразі – практично неконтрольованою...

У 2015 році посол США часів Помаранчевої революції Джон Хербст зізнався, що очікування Майдану 2004 року у боротьбі з корупцією не тільки не справдилися, але й вона значно посилилася.

"В Україні дуже серйозні проблеми з корупцією, тому що, відверто кажучи, верхівка вашої еліти дуже корумпована. Саме найвища верхівка... У списку корупціонерів є навіть ті особи, які дуже гарно вміють говорити "мовою реформ" із країнами Заходу, влучно висловлюватися, процвітаючи при цьому і зберігаючи стару СИСТЕМУ".

"... Їм чудово вдається переходити з однією партії в іншу, часом здійснювати маневри між декількома партіями – і так чи інакше залишатися недоторканими особами та продовжувати процвітати при владі. Вони навчилися процвітати, граючи за старими, але дуже зручними для себе правилами. І якщо вам зручно працювати на посаді міністра (у попередній владі, яку вони критикували, як тільки втрачали посаду), уявіть собі, які будуть у них "зручності" на ще вищому щаблі. Ці люди і є проблемою, і водночас – вони є керівництвом вашої країни...

... Громадянське суспільство в Україні завжди було досить стійке й витривале. Не дивно, що ви провели справжній демократичний референдум щодо незалежності України, що у вас відбулась демократична передача влади ще на перших президентських виборах. Потім на других, коли Кравчук поступився президентським кріслом Кучмі, і все це було перед Помаранчевою революцією! А Помаранчева революція не відбулася б без мобілізованого громадянського суспільства, хоча його мобілізувало вже до того корумповане керівництво...".

"...Я мав проблеми у своєму посольстві (працював там з 2003 по 2006 рр.), бо воно складалося з ентузіастів помаранчевої команди. І я пам'ятаю, що говорив їм дві важливі речі. <title>Ігор Смешко: The New World Order Will Be Defined by New Dividing Lines</title>

On July 13, 2020, the United States stated that China's claims to territories and resources in the South China Sea were 'completely illegal' and condemned 'Beijing's attempts to bring them under its control'.

As is well known, China is disputing control over territories in the South China Sea region with a number of countries in the Asia-Pacific region. It Furthermore, it is no secret that from the very beginning of its existence, the United States has relied on maritime trade as a source of the country's wealth and prosperity. According to various estimates, around 125 million Americans currently live in coastal areas of the US, with 80 per cent of the country's exports and up to 90 per cent of its foreign trade being carried out by sea.

It is no coincidence that Roger Wicker, US Senator and Chair of the US Congress Subcommittee on Maritime Affairs, and Jerry Hendrix, Director of Defence Programmes at the Centre for a New American Security, emphasised in The National Interest: 'Protecting freedom of navigation is a paramount U.S. interest.'

Meanwhile, Washington's aforementioned statement also serves as an indicator of today's large-scale geopolitical shifts as evidenced, for example, by the landmark assertion that 'The world will not allow Beijing to treat the South China Sea as its maritime empire'.

Clearly, the transition to a new world order is gradually approaching its first stage, against the backdrop of attempts to alter the global balance of power, as yet amorphous coalitions of states are emerging in various regions of the world, united solely by shared national interests.

The old world order, with its system of international security law that existed following the end of the Second World War and the Cold War, with its division into the 'World of Democracy' and the 'World of Communism', and later the 'Developing World', is practically ceasing to exist. Russia's annexation of Crimea, without a corresponding response to its military aggression and the changing of borders in the heart of Europe from other nuclear-weapon states that signed the Budapest Memorandum, has also practically buried the system of international law in the field of nuclear non-proliferation.

The isolationism and national self-interest of the current US leadership, China's traditionally distinct ideological path – as it too aspires to global leadership – and the consequences of the coronavirus have significantly accelerated other centrifugal trends which will evidently soon determine the overall direction on the international stage. We are already seeing signs of this today during important votes within the UN.

At the same time, the overall assessment of the situation on the international stage is complicated not only by global instability, which is intensifying year on year, but also by the unpredictability of the superpowers' behaviour, the intensification of an uncontrolled arms race involving both nuclear and conventional weapons, and the emergence of new threats that only yesterday seemed taken straight from the scripts of numerous disaster movies.

We can now observe the onset of a struggle for new global leadership amongst states inclined to disregard human rights – at least human rights in countries other than their own – to impose their will on other members of the international community, and to violate international law, even by countries with a genuine, rather than a fictitious, democratic system. This system, despite all its flaws, nevertheless remains the best possible path for the development of civilisation on the planet.

For the time being, one thing can be said: the dividing line of this confrontation is likely to run along the intersection of the key interests of the United States of America and China, and its arena will evidently be the whole world. Although it is still rather difficult to envisage the exact configuration of the camps of supporters of each of these global poles, there are grounds to believe that its contours will become apparent in the very near future.

That is, if it truly wishes to remain an independent and influential country within the global community.

<title>Ігор Смешко: Elites, Society and Strategies, continued (Theses for the Plan and Strategy to Rebuild Ukraine – 5.4) </title>

As early as the 17th century, Ukraine's history provided grounds for considering it perhaps the most democratic and developed country in Europe. Voltaire attested to this in his writings. In his correspondence with Catherine II, he also noted that Europe did not recognise Muscovy as the successor to Rus. "The only Rus known to us in Europe is that of Kyiv, whose last king was Danylo of Halych,' wrote the great French thinker.



Kozak democracy in Ukraine in the 17th century was more widespread across society than the limited nobility (szlachta) -based democracy of Poland. It offered favourable conditions for further economic development, the fair distribution of land and the development of society free from feudal dependence.

Ukraine enjoyed a favourable climate and possessed around 25 per cent of the world's fertile black earth reserves. It had freedom-loving, hard-working people, whose lands had seen agricultural development since the Trypillia culture – five millennia before Christ – and whose Scythian ploughmen had sustained the ancient Greek world for centuries.

Economically self-sufficient and always striving for freedom and justice, the Ukrainian people of that era were already able to develop free farming and craftsmanship successfully. This formed the bedrock for the growth of the middle class – the foundation for further democratic development – as well as the social base for the expansion of the Kozak army.

Ukrainian Kozaks were already regarded back then as perhaps the finest professional warriors in Europe. Thus, much as in our own time, Ukraine possessed both its People and its Warriors. And even then, they amazed the world. What was lacking was the Elite.

The Ukrainian political elite in the 17th century was still in the process of formation. Following the fall of Rus under the Mongol invasion in the 13th century, the country's own aristocracy had largely adapted to serving the conquerors. Apart from noble Poland, the neighbours of Kozak Ukraine were despotisms of the Asian type – the Ottoman Empire and Muscovy. Ukraine had no natural geographical defence against them. Its territory was not protected from aggressive autocracies by seas and oceans, as in the USA and Britain, or by mountains, as in Switzerland.

Had the self-absorbed, arrogant and condescending Polish nobility (szlachta) not made a fatal mistake regarding Kozak Ukraine, the destiny of Europe might have been different. Following Hetman Bohdan Khmelnytsky's forced uprising and Ukraine's separation from the Polish-Lithuanian Commonwealth, the countdown to its decline and loss of statehood had begun. Just one year later, in 1655, Swedish troops occupied both the old and new Polish capitals – Krakow and Warsaw.

Muscovy was the main beneficiary of the rift between the two nations. Europe's shield against threats from the East was shattered, and Ukraine's resources were exploited by Muscovy to create its own standing army, preserving its fundamentally Asian-style despotic model of governance.

Although history has no 'what ifs', an equal confederation of democratic Poland, Lithuania, and Ukraine would certainly have prevented the tragedies these nations suffered during the subsequent World Wars. A strong and democratic Ukraine – Europe's largest country by area – is the continent's natural defence against threats from the East. It was not the peoples but the elites who prevented their unification in the 17th century. This pattern recurred after the collapse of the Soviet Union due to the West's lack of a strategy for integrating Ukraine into the EU and NATO. The consequence of this was Russia's 12-year war not only against Ukraine but also, at its core, against the 'collective West'.

The current US ruling elites' insufficient understanding that this is a war of ideologies – global authoritarianism versus global democracy – is in itself a threat. It poses a threat to the US and to the entire world of democracies. It cannot be resolved with a 'good deal' or a 'bargain'. The issue lies in defending the principles of freedom and democracy, which cannot be measured by the profits from real estate deals or by rewards for betrayal and the dismantling of the international legal framework – agreements in which the aggressor and its victim are treated as equal parties, thereby laying the groundwork for a future resurgence of escalation.

The facts speak for themselves. Unlike in Muscovy, the first signs of a constitutional state appeared in Ukraine's predecessor, Rus, as early as the 11th century. This took place during the reign of Yaroslav the Wise, Grand Prince of Kyiv, and his code of laws, the Ruska Pravda (Justice of Rus). It predated the adoption of similar laws even in England. In particular, it predated the famous Magna Carta of 1215, which became one of the foundations of the current, formally unwritten, constitution of Great Britain.

It is worth recalling that the first attempt at constitutional democracy-building in Europe was made by Pylyp Orlyk, Ukrainian Hetman of the Zaporozhian Host. This took place 77 years before the adoption of the United States Constitution. This event predated the political and philosophical works of Montesquieu and Jean-Jacques Rousseau in France, as well as the state-building efforts of the founders of American democracy – George Washington, Thomas Jefferson, John Adams, and Benjamin Franklin.

The Constitution, written and published by Pylyp Orlyk in 1710 under the title "Treaties and Resolutions of the Rights and Freedoms of the Zaporozhian Host", was never put into practice. However, it was published before the text of the United States Constitution, adopted in 1787, came into being. In one of the earliest constitutional texts of the modern era, Pylyp Orlyk proposed limiting the powers of an elected head of state and introducing the democratic principle of the separation of powers among the legislative, executive, and judicial branches.



The answer to the question of why we need to build democracy is simple. It is because there is no other system of governance devised by humankind that protects individual rights, freedom, and human dignity under the law and applies equally to everyone. At the same time, democracies have inherent flaws and are vulnerable to external aggression and the destructive actions of corrupt politicians from within.

The stability of democracies is ensured only by the simultaneous and systematic functioning of three key components: society, the elites and sound strategies. These must operate in unison and in accordance with the laws governing the existence of democracies. People who come to power without this knowledge become the gravediggers of democracies, even with the sincerest of good intentions.

The French statesman and thinker Alexis de Tocqueville (1805-1859) drew attention to the shortcomings of democracies as far back as the 19th century. In his book "Democracy in America", he examined the architecture of US democracy and analysed the contradictions inherent in its models of governance. He noted that no democracy can take the perfect form of an ideal and is, in essence, a process that develops gradually, requires great effort and never achieves absolute perfection.

The essence of this democratic governance process is the constant search for ways to resolve contradictions, find compromises, and strike a balance among interests within society.



The advantages of democracies, in his view, included equal opportunities to succeed through productive, socially beneficial work, as well as social engagement, mobility, and advancement, which fuel economic progress. The disadvantages include an equality that disregards individual merit and the authority of the past, in which the voice of a distinguished and educated person is equated with that of a self-absorbed professional ignoramus. This fuels individualism and selfishness.

In the absence of established cultural and historical traditions in society that might be described as conservative, the transformation of the 'man in the street' into a ruling elite may lead to a decline in the spirituality and morality of society. He regarded religion, which nurtures moral principles, as a possible counterbalance. It is precisely through religion that the abuse of freedom can be avoided, its descent into anarchy prevented, and the stability and morality of society maintained.

De Tocqueville emphasised the importance of fostering the political culture of voting citizens. He regarded the selection of appropriate strategies and models for decentralising power and local self-government as the institutional means of achieving this. Without this, the political education of voters and active citizen participation in political life become impossible. The experience of ancient Greek democracies shows that effective governance, the selection of competent authorities, and their effective oversight are best achieved in small groups of people – that is, when power is brought as close as possible to the electorate.

De Tocqueville regarded the potential 'tyranny of the majority' as another flaw of democracy. In a democracy, there is always a risk that, after winning an election, the majority may impose its will on the minority. The protection of minority rights must counterbalance this. Institutionally, this can be ensured through the adoption of relevant laws, such as a law on the impeachment of the president and a law on the opposition in parliament, as well as through the judiciary's independence from the executive.

The model of political governance must necessarily include a statutory definition of the opposition's rights in parliament, as well as legally defined procedures for overseeing the executive branch and safeguarding the independence of the courts, with the principles of the rule of law and public oversight of all three branches of government enshrined in the constitution.

In this regard, de Tocqueville argues that freedom of speech and freedom of the press play a vital role. Independent and professional media form the basis for disseminating accurate information within society, ensuring government transparency and deterring authority from abuse and corruption. Freedom of speech, once appropriate models of political governance and local self-government have been chosen, is the guarantor of the formation of the political culture of the electorate. It also determines whether society is accurately informed about external and internal threats to the country, its citizens and its democratic institutions.

De Tocqueville admired the contemporary model of American democracy. He emphasised the fine balance between freedom, equality, religion and civic engagement. We must not forget that the slaves who ensured the prosperity of the American middle class of that era were not full citizens or voters. He stressed the need to adapt the complex system of governance to new living conditions. He warned that the emergence of a 'slave mentality' amongst voters posed a threat to democracy and could destroy the balance between freedom and equality. He drew on the experience of ancient Rome: 'Slaves dream not of freedom, but of becoming masters'.

The researcher also warned of the possibility of 'hidden tyranny', which arises when the level of political culture among elites, society, and the electorate declines. Tyrants can come to power through democratic elections. Once in power, they will inevitably attempt to bring all aspects of citizens' lives under their control. The consequence of this will be the destruction of the mechanisms for holding those in power to account, a decline in citizens' social engagement and their influence on the country's future.

In analysing concepts such as individualism and civic engagement, de Tocqueville identified yet another contradiction inherent in democracies. Namely, individualism prioritises personal interests while undermining civic engagement and responsibility. Political parties and trade unions, which unite society, can serve as a counterbalance to excessive individualism, but only when they are guided by the laws and ideology of democracy, functioning as ideological parties rather than operating on the principles of organised syndicates designed to satisfy material, egoistic, clannish interests.

The threat posed by selfish individualism to democracies exists not only at the level of citizens' lumpenised psychology, but also at the state level – amongst the country's political elites. In the former case, it is possible to counteract this through political education, spiritual and cultural traditions, and the moral values of religion. In the latter case, it can be countered through a national strategy of joint defence with other democratic countries, both against external enemies – aggressive authoritarianism – and internal ones – systemic state corruption perpetrated by corrupt political wheeler-dealers and hidden tyrants striving for power.

Historical experience shows that the initial construction of democracies is carried out precisely by conservatives, not by liberals. Liberals alone cannot build the socio-economic foundation of democracy – a strong national economy, an army, diplomacy and information policy. However, to successfully complete this process, at least two system-forming parliamentary parties are required: conservative-democratic and liberal-democratic. They must be united by a common goal – the building of democracy – whilst being divided by differing worldviews and the ability to exercise parliamentary oversight over the executive branch.

A conservative approach to safeguarding the nation's cultural and historical traditions, domestic industry, and the domestic market, and to blocking destructive external influences during the initial stage of state-building, can only be ensured by conservatives. The liberal slogan 'the free market will solve everything' is a death sentence for the construction of national democracy. You cannot diagnose or treat a condition based on the average temperature in a hospital ward. Only conservatives are capable of ensuring the growth of the middle class and the rule of law in a country with a separation of powers, whilst blocking attempts at external control over a still-vulnerable nation, particularly from 'globalists'.

Once the country's national institutions of government, the economy and the rule of law have been strengthened, the time for liberals will come. This is because even amongst conservatives in power, the virus of corruption exists, with money and influence acting as its potent stimulants. The consequence could be a creeping slide towards authoritarianism. Periodic and evolutionary liberalisation of excessively concentrated power is a necessity in a democracy. The examples of the modern USA, Hungary and Poland are plain to see. However, the sequence of these processes matters.

The explanation is simple: to improve something, you must first create it. One does not carry out finishing work or furnish a house without a foundation, walls, and a roof-to say nothing of the external influence from those who have no need for a robust national authority and a strong economy. It prevents 'globalists' from covertly appropriating resources and exerting political influence through their puppet politicians. The security services of authoritarian countries are likewise active. The success of democracies spells doom for dictatorships in their own countries. For transnational corporations, the national interests of states – even democratic ones – are secondary. They are not interested in ideology, but in their own profits. It is always easier to plunder the weak.

Finally, only conservative values are rooted in the bedrock of national traditions. An appeal to tradition is an integral feature of conservatism. Its global proponents included figures such as Edmund Burke, Alexis de Tocqueville, David Hume, General de Gaulle, Winston Churchill, Margaret Thatcher, Ronald Reagan, Vyacheslav Lypynsky and many other thinkers and distinguished statesmen.

Vyacheslav Lypynsky, the ideologue of Ukrainian neoconservatism during the Hetmanate of Pavlo Skoropadsky, asserted that national revival begins precisely with the revival of political elites. By this he meant all those capable of becoming 'leaders and organisers of the nation'. He called them the 'national aristocracy' and was convinced that such people must be self-sufficient, educated, of high moral character and possess certain resources for their activities – not oligarchic resources, but sufficient to ensure their own independence. Above all, they must 'conform to those concepts of legality and public morality by which the entire nation lives at any given historical moment'.

In other words, "the national aristocracy must possess, in addition to material power, moral authority in the eyes of its nation." "Without these fundamental characteristics – material strength and moral authority – there is not, and cannot be, a national aristocracy. And without a national aristocracy – without strong and authoritative leaders and organisers of the nation in its arduous struggle for existence – there is not, and cannot be, the nation itself."

Speaking of the era of the liberation struggle at the beginning of the last century, he also emphasised: "We absolutely must form people capable of public service. The current generation of Ukrainian politicians can be creative only in the cultural sphere; in the political sphere, however, it is destructive." Prophetic words, the lessons of which we are still only now internalising...

<title>Ігор Смешко: Світанок України</title>

<fulltext>Для відновлення самодостатності і суб'єктності України після закінчення війни з Росією економіка відіграватиме визначальну роль. Саме вона є основою безпеки і добробуту будь-якої держави світу. Але у випадку з Україною без зміни її моделі із сировинно-придаткової на інноваційно-виробничу гарантувати безпеку держави поруч з авторитарною Росією буде неможливо. Так само неможливо буде побудувати справді суверенну демократію із надійним захистом прав, свобод і добробуту її громадян.

Економіка ґрунтується на природних ресурсах, технологіях, продуктивній праці, інноваціях, людському капіталі, фінансах та екології. За умови належного планування й ефективного управління саме вона може стати передвісником прекрасного майбутнього і нового, яскравого Світанку для України.



Проте в руках некомпетентної і корумпованої, або байдужої та знахабнілої політичної й економічної псевдоеліти економіка породжує хаос, залежність і марнотратство. Першою ознакою таких "еліт" є їхні догми: "лібералізм, вільний ринок і глобалізм самі все врегулюють", "держава – неефективний менеджер", "ефективний менеджер", навіть без фахової освіти та відповідної біографії, є кращим керівником у будь-якій сфері державного управління".

У попередніх блогах – "Викрадення Держави" і "Назад у майбутнє" (https://blogs.pravda.com.ua/authors/smeshko/69f8687f71a14/) (https://blogs.pravda.com.ua/authors/smeshko/6a0ca99c5b606/) – ми аналізували, як майбутнє України було "викрадене" раніше і що необхідно зробити, щоб уникнути помилок минулого під час його подальшого будівництва.

Досвід дванадцятирічної війни вже довів, що Народ і Воїни України вміють вести й вигравати війни за виживання та змінювати хід історії. Зупиняти знахабнілих диктаторів і виживати в обставинах, у яких інші народи не змогли б вистояти. І все це – не завдяки мудрим і далекоглядним елітам, а навпаки, навіть за їх фактичної відсутності.

Нещодавно прем'єр-міністр Данії ще раз публічно визнала, що Україна вистояла не завдяки ефективному уряду чи допомозі Заходу, а насамперед завдяки самим українцям. Але їхня місія ще не завершена. Вони мають проявити таку ж відданість у мирному відновленні власної економіки, як зробили це під час війни. Без цього Майбутнє буде втрачено.

І кожна зі складових економіки – природні ресурси, енергетика, технології, продуктивна праця, інновації, управління людським капіталом, екологія та фінанси – потребуватиме нової Еліти управління. Тому що ці складові економіки є лише будівельними блоками одного цілого і потребують для його зведення професійних державників-будівельників, а не аматорів-популістів.

Таких людей в Україні вдосталь, але їх здебільшого відсунули на другий план. Прикладом може бути один із найруйнівніших для енергетики й економіки України випадків – ігнорування Верховною Радою України протягом 22 років проєкту Закону про Єдину державну систему моніторингу енергетичних ресурсів і тарифів на ЖКП (ЄДСМ).

Його розробникам був фактично закритий доступ до влади, а Верховна Рада, порушуючи Конституцію, сприяла гігантській корупції та підриву основ державності. Законопроєкт про ЄДСМ був підготовлений Кабінетом Міністрів за дорученням РНБО України ще у 2002-2003 роках. Він кілька разів був проголосований Верховною Радою у першому читанні, але протиправно блокувався для ухвалення у другому читанні.

У разі прийняття цього Закону він забезпечив би наскрізний моніторинг енергетичних ресурсів – нафти, газу, електроенергії, тепла, води тощо – шляхом створення єдиної, уніфікованої національної бази даних енергетичних потоків України. Це, своєю чергою, забезпечило б енергетичну безпеку й енергетичну незалежність України, справжній антикорупційний контроль, ефективне кризове управління, прозоре планування та формування державних доходів.

До сьогодні, попри численні спроби фахових патріотів відродити цей законопроєкт, корумповане "енергетичне лобі" в парламенті продовжує його блокувати.

Наслідки для України – катастрофічні. Неприйняття Закону, який мав би регулювати видобуток, розподіл, вартість і продаж найбільшого споживчого товару – енергії, що впливає на особистий бюджет і добробут кожного українця, створило системну корупцію гігантських масштабів. Вартість втрат державного бюджету за роки незалежності України внаслідок цього може сягати 150 мільярдів доларів США.

При цьому й нинішній парламент міг би переглянути всі редакції законопроєкту про ЄДСМ, визначити, які його положення можуть бути інтегровані у сучасні системи цифрової обробки даних, і нарешті завершити роботу професіоналів, розпочату ще двадцять два роки тому.

Це створило б не лише систему енергетичного контролю, якої Україна так потребує, а й надало б модель для обліку та управління сотнями мільярдів доларів, які очікуються для її післявоєнного відновлення.

Попереду багато роботи, і кожен громадянин України має усвідомити: Майбутнє держави залежатиме також від того, кого люди оберуть до нового парламенту та на посаду Президента.

З огляду на складність побудови нової інноваційно-виробничої моделі економіки, обов'язком кожного громадянина-виборця має стати об'єктивна оцінка кожного кандидата до влади. З орієнтацією на його перевірену часом біографію, попередні досягнення, освіту, доброчесність і любов до України.

Нехтування цим громадянським обов'язком є, по суті, аналогом дезертирства з фронту. Адже саме нові й справжні політичні Еліти мають запровадити нову економічну модель, яка найкраще слугуватиме національним інтересам.

На зміну нинішній владі та феодально-клановим інтересам олігархів, які або стоять за нею, або співпрацюють із нею, мають прийти нові програми і стратегії. Такі, що підтримуватимуть малий і середній бізнес та створюватимуть умови для розвитку масового сімейного фермерства.

Окремо стоїть питання підвищення зарплат висококваліфікованим і освіченим фахівцям – вчителям, лікарям, військовослужбовцям, представникам творчої та наукової інтелігенції, а також державним службовцям. Без цього стримати трудову міграцію найбільш підготовлених і важливих для національної безпеки кадрів та повернути тих, хто вже виїхав за кордон, буде вкрай складно.

Держава повинна нарешті втрутитися у формування тарифів на житлово-комунальні послуги в інтересах пересічних громадян і місцевих громад та ефективно прив'язати їх до реальних доходів населення. Українці витрачають на ці послуги 30-50 % своїх доходів, тоді як громадяни країн ЄС – лише 15-20 %. При тому, що Україна має один із найвищих у світі показників приватної власності на будинки і квартири. Це є гарною основою для формування середнього класу – базового захисника демократії, за умови стримування вартості комунальних та інших витрат.

Із перших днів незалежності й донині практично всі уряди зазнали серйозної невдачі, фактично самоусунувшись від виконання свого конституційного обов'язку щодо регулювання використання земельних ресурсів і багатих надр України.

Ці мінеральні та інші природні ресурси, згідно з Конституцією, належать громадянам України і повинні використовуватися для полегшення їхнього фінансового тягаря, зміцнення національної економіки та посилення економічного і дипломатичного впливу України у Світі, а не для обслуговування приватних інтересів у змові з можновладцями.

Немає жодних причин, чому українці не можуть мати такий самий рівень життя, як громадяни країн ЄС, і тримати своїх матерів та батьків удома, а не змушувати їх шукати заробітку за кордоном. Більше того, рівень заробітних плат і соціальних гарантій в Україні може і повинен перевищувати середньоєвропейський, якщо держава прагне стимулювати повернення української діаспори та відновити критично необхідний демографічний потенціал країни.

Уряд України також не зміг запобігти втраті високорозвиненого промислового потенціалу держави та зменшити неприйнятний рівень залежності від зовнішніх донорів і кредиторів. На сьогодні не існує цілісних галузевих програм інвестицій та розвитку, не відбувається технологічного оновлення стратегічних галузей – ракетної, авіаційної, суднобудівної та космічної. Так само не налагоджено національного виробництва мікросхем, сучасної радіоелектронної та біоінженерної продукції.

Лише розумне державне регулювання і протекціонізм здатні, через фінансування відповідних науково-дослідних і дослідно-конструкторських робіт, підтримувати довгострокові фундаментальні дослідження та створювати стимули для інновацій через ефективну систему захисту інтелектуальної власності й патентного права.

Коротко кажучи, Україна має всі необхідні передумови для побудови розвиненої європейської демократії з потужним середнім класом, активним і відповідальним громадянським суспільством, ринковою економікою, державним регулюванням стратегічно важливих галузей, всебічним захистом національного виробника, включно із сільським господарством, а також особливою увагою до науки, освіти, охорони здоров'я і демографічного розвитку українського Народу як основи сильної економіки, боєздатної армії та потужного оборонного потенціалу України.

Для реалізації всього цього українці мають обрати до влади кваліфікованих фахівців, які зможуть повернути державне управління з-під впливу олігархічних груп, подолати наслідки війни та створити підзвітні механізми відбудови й відновлення країни.



Одночасно нова післявоєнна політична Еліта України має розробити, у консультаціях з усіма верствами суспільства, економічні та соціальні програми, які ставлять на перше місце добробут саме громадян України і ознаменують початок нового Світанку для України.

Історія України ще у ХVІІ столітті давала підстави вважати її чи не найбільш демократичною розвинутою країною Європи. Це засвідчував у своїх творах Вольтер. У листуванню з Катериною ІІ він також нагадував, що в Європі Московію не визнавали спадкоємицею Русі. "Єдина Русь, яку ми знаємо в Європі, – це Київська, останнім королем якої був Данило Галицький", – писав великий французький мислитель.



Козацька демократія України у XVII ст. була більш соціально поширеною, ніж обмежена шляхетська демократія Польщі. Вона мала гарні умови для подальшого економічного розвитку, справедливого поділу землі та розвитку суспільства без феодальної залежності.

Україна мала гарний клімат і володіла близько 25% світових запасів чорноземів. Вона мала волелюбний і працьовитий народ, на землях якого ще з часів Трипільської культури, за п'ять тисячоліть до Різдва Христового, існувало розвинене землеробство, а скіфи-орачі з її території століттями кормили давньогрецький Світ.

Економічно самодостатній, завжди прагнучий свободи і справедливості український народ ще у ті часи міг успішно розвивати вільне фермерства і ремісництво. Це було основою для зростання середнього класу – фундаменту подальшого розвитку демократії, а також соціальною базою для зростання чисельності козацької армії.

Українські козаки вже тоді вважалися чи не найкращими професійними воїнами Європи. Отже, як і в наші часи, Народ і Воїни в Україні були. І вже тоді дивували Світ. Бракувало Еліти.

Політична українська еліта у XVII ст. перебувала ще у стадії формування. Власна аристократія після падіння Русі під ударами монгольської навали у XIII ст., здебільшого пристосувалася до служіння завойовникам. Окрім шляхетської Польщі, сусідами козацької України були деспотії азійського типу – Османська імперія та Московія. Україна не мала природного географічного захисту від них. Її територія не була захищена від агресивних автократій морями й океанами, як США і Британія, або горами, як Швейцарія.

Якби самозакохана, пихата і зверхня до інших польська шляхта не припустилася фатальної помилки щодо козацької України, доля Європи могла б бути іншою. Після вимушеного повстання гетьмана Богдана Хмельницького та відокремлення України від Речі Посполитої таймер її занепаду і втрати державності був запущений. Уже через рік після цього, у 1655 році, стару і нову польські столиці – Краків і Варшаву – окупували шведські війська.

Головним вигодонабувачем розриву між двома народами стала Московія. Щит Європи від загроз зі Сходу був зруйнований, а ресурси України використані Московією для створення власної регулярної армії при збереженні в ній азійської за своєю суттю деспотичної форми правління.

Незважаючи на те, що історія не має умовного способу, рівноправна конфедерація демократичних у своїй основі Польщі, Литви та України гарантовано запобігла б трагедіям цих народів під час наступних Світових воєн. Сильна і демократична Україна – найбільша за площею країна Європи – є природним захистом континенту зі Сходу. Їх об'єднанню у XVII ст. завадили не Народи, а Еліти. Це повторилося і після розпаду Радянського Союзу через відсутність будь-якої стратегії Заходу щодо інтеграції України до ЄС і НАТО. Наслідком цього стала 12-річна війна Росії не лише проти України, а й, у своїй основі, проти "колективного Заходу".

Недостатнє розуміння нині правлячими елітами США того, що це війна ідеологій – світового авторитаризму проти світової демократій, – саме по собі є загрозливим. Як для США, так і для усього Світу демократій. "Гарною угодою" і ґешефтом її не завершити. Питання полягає у захисті принципів свободи і демократії, які не вимірюються категоріями прибутку від рієлторських угод чи винагородою за зраду і руйнацію системи міжнародного права. Угод, у яких агресор і його жертва визнаються рівноправними учасниками, чим закладається основа для подальшого відновлення ескалації.

Факти ж є такими. На відміну від Московії, паростки правової Держави з'явилися у предтечі України – Русі – ще у ХІ ст. Це сталося за часів правління Великого князя Київського Ярослава Мудрого та його зводу законів "Руська правда". Він з'явився раніше, ніж подібні закони були прийняті навіть в Англії. Зокрема, раніше за знамениту "Велику хартію вольностей" 1215 року, яка стала однією з основ нинішньої, формально неписаної, конституції Великої Британії.

Нагадаємо, що першу спробу конституційного будівництва демократії в Європі здійснив український гетьман Війська Запорозького Пилип Орлик. Це сталося за 77 років до ухвалення Конституції США. Ця подія випередила політико-філософські праці Монтеск'є та Жан-Жака Руссо у Франції, а також державотворчу діяльність творців американської демократії – Джорджа Вашингтона, Томаса Джефферсона, Джона Адамса і Бенджаміна Франкліна.

Конституція, написана й оприлюднена Пилипом Орликом у 1710 році під назвою "Договори і Постановлення Прав і Вольностей Війська Запорозького", не була втілена в життя. Проте вона побачила світ раніше, ніж з'явився текст Конституції США, ухваленої у 1787 році. В одному з найдавніших конституційних текстів Нового часу Пилип Орлик уперше запропонував обмежити повноваження виборного глави держави та запровадити демократичний принцип поділу влади на законодавчу, виконавчу і судову гілки.



На питання, чому потрібно будувати саме демократію, відповідь проста. Тому що не існує іншої винайденої Людством системи управління, яка б захищала особисті права, свободу і гідність людини згідно із законом, однаковим для всіх. При цьому демократії мають природні вади і є вразливими до зовнішньої агресії та деструктивних дій корумпованих політиків зсередини.

Стійкість демократій забезпечується лише одночасною і системною роботою трьох основних компонентів: суспільства, еліт і правильних стратегій. Вони мають діяти синхронно і відповідно до законів існування демократій. Люди, які приходять до влади без цих знань, стають могильщиками демократій навіть із щирими намірами добра.

Французький державний діяч і мислитель Але&amp;#312;сіс де То&amp;#312;віль (1805-1859 рр.) ще у XІХ ст. звернув увагу на вади демократій. У книзі "Демократія в Америці" він дослідив архітектуру демократії США і проаналізував суперечності, притаманні її моделям управління. Він зазначив, що будь-яка демократія не може мати завершеної форми ідеалу і є, по суті, процесом, який розвивається поступово, потребує великих зусиль і ніколи не досягає абсолютної досконалості.

Сутністю цього процесу управління в умовах демократії є постійний пошук шляхів розв'язання суперечностей, пошук компромісів і балансів інтересів у суспільстві.

До переваг демократій він відносив рівні умови для досягнення успіху завдяки продуктивній і суспільно корисній праці. Наявність соціальної активності, мобільності та соціальних ліфтів, які живлять економічний прогрес. До вад – рівність без урахування цінності особистості і авторитету минулого, де голос заслуженої й освіченої людини прирівнюється до голосу самозакоханого фахового невігласа. Це живить індивідуалізм і егоїзм.

За відсутності у суспільстві сталих культурних та історичних традицій, які можна назвати консервативними, трансформація "людини з вулиці" у владну Еліту може призвести до падіння духовності й моралі суспільства. Можливим компенсатором він вважав релігію, яка живить моральні принципи. Саме за її допомогою можна уникати зловживань свободою, запобігати її сповзанню в анархію та підтримувати стабільність і моральність суспільства.

Де То&amp;#312;віль підкреслював важливість піклування про підвищення політичної культури громадян-виборців. Інституційним засобом для досягнення цього він вважав вибір правильних стратегій і моделей децентралізації влади та місцевого самоврядування. Без цього політична освіта виборців і активна участь громадян у політичному житті стають неможливими. Досвід існування давньогрецьких демократій свідчить, що якісне управління, вибір якісної влади та дієвий контроль над нею найкраще реалізуються у невеликих групах людей – тоді, коли влада є максимально наближеною до виборців.

Ще одною вадою демократії Де То&amp;#312;віль вважав можливу "тиранію більшості". При демократії завжди є ризик того, що більшість після перемоги на виборах може нав'язувати свою волю меншості. Компенсатором цьому має стати захист прав меншості. Інституційно це можна забезпечити через прийняття відповідних законів, наприклад, закону про імпічмент президента та закону про опозицію в парламенті, а також через незалежність судової гілки влади від виконавчої.

Модель політичного управління має обов'язково включати законодавче визначення прав опозиції у парламенті, а також визначені законом процедури контролю над виконавчою гілкою влади і захисту незалежності судів із конституційним закріпленням принципів верховенства права та громадянського контролю над усіма трьома гілками влади в країні.

У цьому сенсі важливу роль відіграють, згідно з Де То&amp;#312;вілем, свобода слова і свобода друку. Незалежні і фахові ЗМІ є основою для поширення правдивої інформації у суспільстві, забезпечення прозорості влади та стримування її від зловживань і корупції. Свобода слова, після правильно вибору моделей політичного управління і місцевого самоврядування, є гарантом формування політичної культури виборців. Від неї залежить і правдиве інформування суспільства про зовнішні та внутрішні загрози для країни, громадян і демократичних інститутів влади.

Де То&amp;#312;вілю подобалась сучасна модель американської демократії. Він підкреслював гарну збалансованість свободи, рівності, релігії та громадянської активності. Не забуваємо, що раби які забезпечували добробут американського середнього класу тих часів, не були повноцінними громадянами і виборцями. Він наголошував на необхідності адаптації складної системи управління до нових умов існування. Застерігав, що поява серед виборців "рабської психології" є загрозою для демократії і може зруйнувати баланс між свободою і рівністю. Нагадував давньоримський досвід: "Раб не мріє про власну свободу, він мріє про власних рабів".

Дослідник застерігав також від можливості "прихованої тиранії", яка з'являється, коли падає рівень політичної культури еліт, суспільства і виборців. Тирани можуть приходи до влади і шляхом демократичних виборів. Отримавши владу, вони неодмінно спробують взяти під контроль усі аспекти життя громадян. Наслідком цього стане руйнація механізмів контролю над владою, падіння соціальної активності громадян та їхнього впливу на долю країни.

Аналізуючи такі поняття, як індивідуалізм і громадянська активність, Де То&amp;#312;віль виявив ще одне протиріччя демократій. А саме: індивідуалізм надає пріоритет особистим інтересам, але водночас послаблює громадянську активність і відповідальність. Компенсацією надмірного індивідуалізму можуть стати політичні партії і професійні спілки, які гуртують суспільство. Але лише тоді, коли вони керуються законами та ідеологією демократії, є ідеологічними партіями, а не діють за принципами організованих угрупувань для задоволення матеріальних, егоїстично-кланових інтересів.

Загроза егоїстичного індивідуалізму для демократій існує не лише на рівні люмпенізованої психології громадян, але й на державному рівні – серед політичних еліт країни. У першому випадку протидіяти цьому можливо за рахунок політичної освіти, духовних і культурних традицій та моральних цінностей релігії. У другому – шляхом національної стратегії спільного з іншими країнами демократії захисту як від зовнішніх ворогів – агресивного авторитаризму, так і від внутрішніх – системної державної корупції з боку корумпованих ділків-політків і прихованих тиранів, які рвуться до влади.

Первинне будівництво демократій, як свідчить історичний досвід, здійснюють саме консерватори, а не ліберали. Соціально-економічну основу демократії – міцну національну економіку, армію, дипломатію і інформаційну політику – самі лише ліберали збудувати не можуть. Однак для успішного завершення її будівництва потрібні щонайменше дві системотворчі парламентські партії: консервативно-демократична і ліберально-демократична. Їх має об'єднувати спільна мета – будівництво демократії, а розділяти – різні погляди на світ і здатність контролювати виконавчу гілку влади з позицій парламенту.

Консервативний підхід до захисту культурно-історичних традицій народу, національного виробника, внутрішнього ринку і блокування деструктивного впливу ззовні на первинному етапі державного будівництва можуть забезпечити лише консерватори. Гасло лібералів "усе вирішить вільний ринок" – це вирок для будівництва національної демократії. Середньою температурою по палаті діагноз не ставлять і не лікують. Тільки консерватори здатні забезпечити зростання середнього класу і верховенство права в країні із поділом гілок влади та блокуванням спроб зовнішнього управління ще слабкою країною, насамперед з боку "глобалістів".

Після зміцнення національних інститутів влади, економіки і законності в країні приходить час лібералів. Тому, що і серед консерваторів при владі існує вірус корупції. Гроші і влада є для нього потужним стимулятором. Наслідком може стати приховане сповзання до авторитаризму. Періодична і еволюційна лібералізації надмірно сконцентрованої влади є необхідністю при демократії. Приклад сучасних США, Угорщини, Польщі – перед очами. Але, послідовність цих процесів має значення.

Пояснення просте: аби щось покращити, потрібно спочатку його створити. Без фундаменту, стін і даху чистові роботи та меблювання будинку не проводять. Не кажучи вже про зовнішній вплив з боку тих, кому міцна національна влада і сильна економіка не потрібні. "Глобалістам" вона заважає приховано привласнювати ресурси та здійснювати політичний вплив через кишенькових політиків. Спеціальні служби авторитарних країн також не сплять. Успіх демократій – це вирок для диктатур у їхніх країнах. Для транснаціональних корпорацій національні інтереси держав, навіть демократичних, є вторинними. Їх цікавить не ідеологія, а власний прибуток. Грабувати слабкого завжди легше.

Нарешті, лише консервативні цінності спираються на скелю національних традицій. Звернення до традиції є невід'ємною рисою консерватизму. Його світовими поширювачами були такі особистості, як Едмунд Бер&amp;#312;, Але&amp;#312;сіс де То&amp;#312;віль, Девід Г'юм, генерал Де Голль, Вінстон Черчилль, Маргарет Тетчер, Рональд Рейган, В'ячеслав Липинсь&amp;#312;ий та багатьох інших мислителів і видатних державних діячів.

В'ячеслав Липинський, ідеолог українського неоконсерватизму часів Гетьманату Павла Скоропадського, стверджував, що національне відродження починається саме з відродження політичних еліт. До яких він відносив усіх, хто здатен стати "провідниками і організаторами нації". Він називав їх "національною аристократією" і був переконаний, що такі люди мають бути самодостатніми, освіченими, високоморальними та володіти певними ресурсами для своєї діяльності. Не олігархічними ресурсами, а достатніми для забезпечення власної незалежності. Головне – вони мають "відповідати тим поняттям законності і громадської моралі, якими живе в даний історичний момент увесь народ".

Іншими словами "національна аристократія мусить мати, окрім матеріяльної сили, ще й моральний авторитет в очах своєї нації". "Без цих основних прикмет – матеріальної сили і морального авторитету – немає і не може бути національної аристократії. А без національної аристократії – без сильних і авторитетних провідників та організаторів нації в її тяжкій боротьбі за існування – немає і не може бути самої нації".

Говорячи про часи визвольних змагань початку минулого століття, він також наголошував "Нам конче треба утворити людей, здібних до державної праці. Сучасне покоління політиків українських може бути творчим тільки в сфері культурній, у сфері ж політичній воно є руїнницьке". Пророчі слова, уроки з яких, ми ще досі лише засвоюємо...

<title>Ігор Смешко: Theses for the Plan and Strategy to Rebuild Ukraine – The Elite, Society and Strategies (Part – 5.3.) </title>

<fulltext>The war that Russia has unleashed against Ukraine is not merely a confrontation between two states or nations. It is a clash between two civilisational models: the European democratic model and the Eurasian authoritarian one.

Although Western politicians spent decades convincing themselves and their societies that Russia was gradually moving towards democracy, this was never the case in reality. The voices of Ukrainian experts and analysts were often ignored in the West, even though Russia itself has long openly declared – and continues to declare today – that its so-called "special military operation" is, in fact, a war against the so-called "Collective West". By this term, the Kremlin refers to all democratic nations worldwide, and it cites "the end of US hegemony" as one of its strategic goals.

The true aim of the war unleashed by Russia lies not merely in the destruction of Ukrainian statehood, the elimination of Ukraine's independence and its annexation. It is also an attempt to defeat global democracy – the democratic West as a civilisational model. If successful, Russia seeks to establish control over what it itself describes as a "degenerating" and "decadent" Europe, as well as to promote the formation of a new multipolar world in which the leadership of democratic countries and the US will be replaced by the dominance of authoritarian regimes.

For centuries, Ukraine has remained a gateway to European civilisation and global democracy. Today, it effectively serves as Europe's shield, containing Russia's authoritarian Eurasian expansion.

In his book Bloodlands, Yale University professor Timothy Snyder acknowledged that the most tragic events of 20th-century Europe took place on Ukrainian territory: two world wars, the revolution, collectivisation, the Holodomor, the repression of the Ukrainian intelligentsia and the 'purges' of so-called 'bourgeois Ukrainian nationalism'. Ukraine lost tens of millions of its citizens. Yet despite centuries of subjugation and a lack of political experience of independent statehood, the spirit of freedom among the Ukrainian people was not destroyed. It intuitively broke through from within – through the pursuit of dignity, freedom and independence. The two Ukrainian Maidan Uprisings and over twelve years of resistance to Russian aggression stand as testimony to this enduring aspiration.

To consolidate Ukraine's European democratic path of development, the strengthening of four key components of national power should constitute the central priorities of state strategy: ECONOMY, ARMED FORCES, DIPLOMACY, and INFORMATION POLICY. Equally critical is the existence of a responsible political elite capable of implementing this strategy in the interests of both the state and society.

Particular emphasis must be placed on developing an industrial, innovative economy and prioritising national material production. Ukraine must produce goods with maximum added value and ensure the strategic self-sufficiency of its own military-industrial complex. First and foremost, this applies to the production of modern weapons and military equipment, an area in which Ukraine has traditionally possessed strong scientific and engineering capabilities.

As the largest country in Europe by area and one of the world's key food producers, Ukraine can feed hundreds of millions of people worldwide. At the same time, it must reclaim its place among the world's most developed industrial nations. Following the return of all temporarily occupied territories, the Ukrainian army must remain strong enough to prevent any new aggression against Ukraine.

Success in the restoration and development of the Ukrainian economy must serve as a driving force for creating conditions to reduce the tax burden, strengthen the socio-economic protection of the middle class, and foster the flourishing of small and medium-sized businesses. This is precisely what must form the basis for the realisation of Ukraine's National Idea in its three dimensions: spiritual, socio-economic and state-building:

1. GOD, FREEDOM, FAMILY and UKRAINE have always been and will remain the highest spiritual values of the UKRAINIAN PEOPLE;

2. CULTURE, SCIENCE, LAND and PROPERTY, fairly and equitably distributed between citizens and the state, will always constitute the foundation of UKRAINE's prosperity;

3. ELECTIONS, SOCIAL JUSTICE, THE RULE OF LAW and THE ARMY must always protect the rights of Ukrainians to life, freedom and a dignified future, as well as defend the unity and independence of the UKRAINIAN STATE.

States are built by aristocrats – people who dedicate their lives to establishing an honourable reputation and passing it on unblemished to the next generation. For them, service to society is the very purpose of life, while the gravest punishment is the loss of honour and public disgrace. "Honour above all" is not merely a lofty slogan; it is the foundation of genuine statesmanship and public responsibility.

Unfortunately, we have largely lost such a political elite. It was eradicated over the course of a century, whilst its finest representatives served other governments, often demonstrating loyalty, professionalism, and integrity in those capacities.

Nor have we succeeded in forming a new responsible political elite. Instead, following independence, the old pseudo-elite of party and Komsomol functionaries, along with various opportunists and profiteers, largely re-emerged. They are not burdened by strategic thinking about the greatness of the state, the future of the nation, or responsibility towards future generations.

To this day, there is virtually no genuinely ideological party in the Ukrainian parliament that realises that, under contemporary conditions, effective democracy is the only sustainable model for building a strong state.

Attempts to build a democratic state in Ukraine have often been discredited by populism, political irresponsibility, and the imitation of reforms. Some political forces, whilst professing commitment to democratic values, frequently reproduced authoritarian methods of governance in practice, causing no less damage to the country's democratic development than the open opponents of democracy.

The fact that we have found ourselves at the epicentre of a clash between two civilisations without a strong government, a robust economy, a strong army, and a responsible elite marks a critical turning point. Beyond this point, we must either begin to act exclusively in the interests of our own state and nation, or face destruction.

Under current conditions, there can be only one national development strategy for Ukraine: the construction of a developed and effective European democracy. Such a democracy must be supported by a socially oriented market economy, a strong middle class, and a mature civil society. It should combine limited state regulation of strategically important sectors of industry and agriculture with the preservation and further development of the country's defence capabilities.

Because without a strong middle class, an active civil society, and independent branches of government subject to public scrutiny, there can be no free citizens of the state. And without free citizens, true democracy cannot exist either.

Thomas Jefferson, the author of the Declaration of Independence, is credited with the following statement: "True independence, freedom and democracy are not a toy given to children. It is a very serious matter, which can only be exercised by highly educated, strong and courageous people, for whom personal dignity is one of the highest virtues of human life."

Conversely, global experience convincingly demonstrates that it is effective democracy that provides the highest standards of living, the strongest guarantees of citizens' rights and freedoms, and the greatest level of security – both within the state and on the international stage.

Ukraine has no alternative path. At the same time, this is a historic opportunity for our state to become a connecting link, a contributor to security and, finally, a full-fledged political player in the formation of a new European security space. This is precisely how Ukraine can contribute to the completion of the European and Euro-Atlantic integration process and make its own historic contribution to the continued peaceful and evolutionary process of interpenetration and gradual integration of the world's civilisations.

<title>Ігор Смешко: Тези до Плану і Стратегії Відновлення України – Еліти, Суспільство і Стратегії (частина – 5.3.) </title>

<fulltext>Війна, яку Росія розв'язала проти України, – це не просто протистояння двох держав чи народів. Це зіткнення двох цивілізаційних моделей: європейської демократичної та євразійської авторитарної.

Попри те, що західні політики десятиліттями переконували себе й суспільства у нібито поступовому русі Росії до демократії, у реальності цього ніколи не відбувалося. Голоси українських фахівців і аналітиків на Заході часто ігнорувалися, хоча сама Росія давно відкрито заявляла – і продовжує заявляти сьогодні, – що її "спеціальна військова операція" є війною проти так званого "Колективного Заходу". Під цим поняттям Кремль розуміє всі демократичні держави світу, а однією зі своїх стратегічних цілей називає "кінець гегемонії США".

Справжня мета розв'язаної Росією війни полягає не лише у знищенні української державності, ліквідації незалежності України та її поглинанні. Йдеться також про спробу завдати поразки світовій демократії – демократичному Заходу як цивілізаційній моделі. У разі успіху Росія прагне встановити контроль над, як вона сама визначає, "деградуючою" та "декадентською" Європою, а також сприяти формуванню нового багатополярного світу, у якому лідерство демократичних країн і США буде замінене домінуванням авторитарних режимів.

Україна ж упродовж століть залишається брамою європейської цивілізації та світової демократії. Сьогодні вона фактично є щитом Європи, стримуючи авторитарну євразійську експансію Росії.

Професор Єльського університету Тімоті Снайдер у своїй книзі Криваві землі визнав, що найтрагічніші події Європи ХХ століття відбувалися саме на українських землях: дві світові війни, революція, колективізація, Голодомор, репресії проти української інтелігенції та "зачистки" так званого "буржуазного українського націоналізму". Україна втратила десятки мільйонів своїх громадян. Але навіть попри століття поневолення та нестачу політичного досвіду незалежного державного існування, дух свободи в українському народі не був знищений. Він інтуїтивно проривався зсередини – через прагнення до гідності, свободи та незалежності. Свідченням цього стали два українські Майдани та понад дванадцять років спротиву російській агресії.

Для утвердження європейського демократичного шляху розвитку України ключовими пріоритетами державної стратегії мають стати зміцнення чотирьох основних складових національної сили: ЕКОНОМІКИ, АРМІЇ, ДИПЛОМАТІЇ та ІНФОРМАЦІЙНОЇ ПОЛІТИКИ. Водночас критично важливою є наявність відповідальної політичної аристократії, здатної реалізувати цю стратегію в інтересах держави та суспільства.

Особливий акцент має бути зроблений на розвитку індустріально-інноваційної економіки та пріоритеті національного матеріального виробництва. Україна повинна виробляти продукцію з максимальною доданою вартістю та забезпечити стратегічну самодостатність власного військово-промислового комплексу. Насамперед – у виробництві сучасних зразків озброєння і військової техніки, у яких Україна традиційно має потужний науковий та інженерний потенціал.

Будучи найбільшою за територією державою Європи та одним із ключових світових виробників продовольства, Україна здатна забезпечувати харчуванням сотні мільйонів людей у світі. Водночас вона має повернути собі місце серед найбільш розвинених індустріальних держав світу. Після повернення всіх тимчасово окупованих територій українська армія повинна залишатися достатньо сильною, щоби унеможливити будь-яку нову агресію проти України.

Успіх у відновленні та розвитку української економіки має стати локомотивом для створення умов зі зниження податкового тиску в Україні, посилення соціально-економічного захисту середнього класу, а також розквіту малого і середнього бізнесу. Саме це має стати основою для реалізації Національної ідеї України у трьох її вимірах: духовному, соціально-економічному та державотворчому:

1. БОГ, СВОБОДА, СІМ'Я і УКРАЇНА – завжди були й залишатимуться найвищими духовними цінностями УКРАЇНСЬКОГО НАРОДУ;

2. КУЛЬТУРА, НАУКА, ЗЕМЛЯ та ВЛАСНІСТЬ, справедливо і збалансовано розподілені між громадянами та державою, – завжди будуть основою добробуту УКРАЇНИ;

3. ВИБОРНІСТЬ, СОЦІАЛЬНА СПРАВЕДЛИВІСТЬ, ЗАКОННІСТЬ і АРМІЯ – мають завжди захищати права українців на життя, свободу і гідне майбутнє, а також боронити соборність і незалежність УКРАЇНСЬКОЇ ДЕРЖАВИ.

Держави будують аристократи – люди, які покладають своє життя на те, щоб створити чесне ім'я і незаплямованим передати його наступному поколінню. Для них служіння суспільству є сенсом життя, а найстрашнішим покаранням – втрата честі та суспільний сором. Честь понад усе – це не гучні слова, а основа справжньої державницької відповідальності.

Ми, на жаль, значною мірою втратили таку політичну еліту. Її винищували протягом цілого століття, а найкращі представники служили іншим урядам, часто демонструючи там приклади вірності, професіоналізму та честі.

У нас так і не сформувалася нова відповідальна політична еліта. Натомість після здобуття незалежності значною мірою "розконсервувалася" стара псевдоеліта з партійно-комсомольських функціонерів та "спритних ділків". Вони не обтяжені стратегічним мисленням про велич держави, майбутнє нації та відповідальність перед наступними поколіннями.

До сьогодні в українському парламенті фактично немає жодної по-справжньому ідеологічної партії, яка б усвідомлювала, що в сучасних умовах єдиною стійкою моделлю розбудови сильної держави є ефективна демократія.

Спроби побудови демократичної держави в Україні часто були дискредитовані популізмом, політичною безвідповідальністю та імітацією реформ. Частина політичних сил, які декларували відданість демократичним цінностям, на практиці нерідко відтворювала авторитарні методи управління, завдаючи демократичному розвитку держави не меншої шкоди, ніж відкриті противники демократії.

І те, що ми опинилися в епіцентрі зіткнення двох цивілізацій без сильного уряду, потужної економіки, сильної армії та відповідальної еліти, – і є тією межею, за якою ми або почнемо працювати виключно в інтересах власної держави і нації, або загинемо.

Національна стратегія розвитку України в сучасних умовах може бути лише одна – побудова розвиненої та дієвої європейської демократії. Із ринковою соціально орієнтованою економікою, потужним середнім класом і розвиненим громадянським суспільством. З обмеженим державним регулюванням стратегічно важливих галузей промисловості і сільського господарства та збереженням і розвитком власного оборонного потенціалу.

Тому що без потужного середнього класу, активного громадянського суспільства та незалежних гілок влади, які перебувають під контролем суспільства, – не існує вільного громадянина держави. А без вільного громадянина не може існувати й справжня демократія.

Батькові "Декларації про незалежність Північної Америки" Томасу Джефферсон приписують наступний вислів: "Дійсна незалежність, свобода і демократія – це не іграшка, яку дарують дітям. Це дуже серйозна річ, якою можуть користуватися лише високоосвічені, сильні та мужні люди, для яких особиста гідність є однією з найвищих рис людського життя".

І навпаки – світовий досвід переконливо свідчить: саме дієва демократія забезпечує найвищі стандарти якості життя, гарантії прав і свобод громадян та їхню безпеку – як усередині держави, так і на міжнародній арені.

Іншого шляху в України немає. Водночас це історичний шанс для нашої держави стати сполучною ланкою, донором безпеки та, нарешті, повноцінним політичним гравцем у формуванні нового європейського безпекового простору. Саме так Україна може долучитися до завершення процесу об'єднання Європи і Євроатлантики та зробити власний історичний внесок у продовження мирного і еволюційного процесу взаємопроникнення і поступової інтеграції цивілізацій Світу.
